All products are made in our confectionery from the best raw materials and always leave our house fresh. The contractual relationship is based on the following terms and conditions.

scope

Our terms of business and delivery apply exclusively. Conditions of the customer that deviate from our terms and conditions of business and delivery are not valid.

Conclusion of the contract, order modularity

With the order of the goods by the buyer, the contract comes on the basis of the current price lists of the pastry chef Günther Pfeffer at the time of the order. The order can be made in person, by telephone or (if possible using the order form) by fax, email, post or via the online shop. Order processing via the online shop is only possible within Germany. When ordering via the online shop, an order confirmation is sent. Orders with missing details about the client cannot be processed. With his order, the customer confirms that the goods will only be used for end use. Resale or intermediate trade is not permitted under any circumstances.

Depending on your choice, we will send the ordered goods to the address of the customer or to the address of a person or company named by you. In the latter case, we are happy to add your personal greetings to the shipment, as sent when you placed your order.

Subject to change

If, in exceptional cases, raw materials that are necessary for the manufacture of the ordered goods are not available for production, we reserve the right to deliver goods of the same quality from our range and thus to change our service insignificantly.

shipping

Shipping is possible from a gross order value of € 20.00. When shipping the goods, the choice of the transport company is solely at the discretion of the master confectioner Günther Pfeffer. Shipping to delivery addresses in Germany and the EU is usually carried out by German Logistics Systems as an insured package. We ship to the rest of the world by post / DHL. The customer bears the costs of the transport, unless something else is expressly agreed. We will usually dispatch your order the next working day after receipt of the order. Information about delivery times and dates are generally non-binding.

Presents decorated in baskets or filled porcelain items cannot always be sent as shown in the catalog.

Transfer of risk

The risk is transferred to the customer when the shipment is handed over to the transport service provider. We expressly reserve the right to delay deliveries due to high outside temperatures until the time at which the freshness and quality of our high-quality products does not suffer on the way. This case usually occurs when the outside temperature rises above 23 degrees Celsius during the day or, according to the official weather forecast, threatens to rise during the transport.

Prices and shipping costs

The prices apply according to the price lists of the pastry chef Günther Pfeffer valid at the time of the order. All prices quoted in the online shop are in euros including statutory VAT, excluding packaging / postage. These will be billed separately. The invoice paid in advance will be sent separately by post.

Shipping is free for the recipient, the costs are billed to the client.

For the packaging for shipping we charge a flat fee of € 3.00 per shipment. The postage costs within Germany are € 8.00 for items with a shipping weight of up to 5 kg and € 9.50 for items with a shipping weight of up to 10 kg. Information on postage for items weighing more than 10 kg, as well as for items to the EU and the rest of the world, is only possible on request. Our prices include a discount for the cost of disposing of our transport packaging. The goods are shipped in a break-proof cardboard box.

Shop and special offers are not valid for shipping.

Delivery times

Unless expressly agreed otherwise, no delivery periods apply to the delivery. The master confectioner Günther Pfeffer is not bound by deadlines set unilaterally by the buyer.

The master confectioner Günther Pfeffer - insofar as this is reasonable for the buyer - is entitled to make partial deliveries.

Decrease

The buyer must accept the goods when they are handed over by the transport company. If the goods cannot be handed over to the specified delivery address by the transport company for reasons for which the master confectioner Günther Pfeffer is not responsible, or if the buyer or recipient refuses to accept the goods, the master confectioner Günther Pfeffer must charge the buyer the full purchase price . The buyer bears the costs of the return and other costs resulting from the non-acceptance.

The buyer has no right of cancellation or return according to §§ 355, 356 BGB, since the goods can spoil quickly (§ 312 d. Para. 4 No. 1 BGB).

Terms of payment

The customer can pay the purchase price in Germany in advance by bank transfer or the online payment service provider PayPal. A delivery on account does not take place in principle. The invoice amount is to be paid without any deductions. If the customer is in default of payment, we are entitled to charge default interest at a rate of 5% above the respective base rate in accordance with §§ 288 Paragraph 1 and 247 Paragraph 1 BGB, if the customer is a merchant, the default interest increases to 8% above the respective base rate Base rate. Furthermore, the master confectioner Günther Pfeffer reserves the right to hand over the claim to a debt collection company (e.g. Creditreform) for collection after the third reminder. To charge the buyer for any collection costs, costs of chargebacks or other costs of improper payment. For foreign customers from non-EU countries (except Switzerland), only payment by credit card or PayPal is provided. Cash on delivery is not possible.

The business currency is the euro (€). Invoices and payments are only possible in euros (€). German VAT does not apply to customers from non-EU countries.

Retention of title

Transport damage - complaints - liability

The goods must be checked by the buyer when they are handed over by the transport company. Visible transport damage must be confirmed in writing by the transport company. Obvious defects in the goods must be reported immediately, at the latest, however, to master confectioner Günther Pfeffer within 5 calendar days of their becoming visible, in writing or by fax, and the goods must be returned to master confectioner Günther Pfeffer for inspection in their original packaging. The inspection of the returned goods for defects or errors is the responsibility of the person commissioned with the inspection.

If there is a defect for which we are responsible, we are entitled, at our discretion, to either remedy the defect or make a replacement delivery. If the elimination of the defect fails, or is not ready or able to rectify the defect or a replacement delivery, or if this is delayed beyond a reasonable period for reasons for which we are responsible, the customer is entitled to withdraw from the contract.

Any further claims by the customer are excluded. This limitation of liability does not apply if the cause of the damage is based on intent or gross negligence. It also does not apply if the customer makes claims for damages due to the lack of a guaranteed property.

We accept no liability for improper storage.

Master confectioner Günther Pfeffer is liable for damages and for reimbursement of the wasted expenses according to § 284 BGB (hereinafter "damages") due to defects in delivery or service or due to breach of other contractual or non-contractual obligations, in particular from tort, only in the case of intent and gross negligence . The above limitation of liability does not apply in the event of a breach of a procurement risk, the breach of essential contractual obligations or liability under the Product Liability Act. Compensation for breach of essential contractual obligations is limited to the replacement of such damage, if the contract was concluded due to the pastry chef Günther Pfeffer, for the recognizable circumstances, the pastry chef Günther Pfeffer should have foreseen as a possible consequence (consequences typical of the contract), unless there is intent or gross negligence or because of there is liability for injury to life, limb or health or the assumption of a guarantee or a procurement risk. All liability restrictions apply to the same extent for vicarious agents and vicarious agents. A change in the burden of proof to the detriment of the buyer is not associated with the above regulations.

Offsetting - assignment

The buyer can only set off counterclaims against claims insofar as these are undisputed or have been legally established. The assignment of claims by the master confectioner Günther Pfeffer against is only possible with their prior written consent. There is no entitlement to such consent. Section 354a of the German Commercial Code (HGB) remains unaffected.
